IntroductionWelcome to AMEY FOUNDATION.These Terms & Conditions govern access to and use of the AMEY FOUNDATION website, digital services, communication channels, online forms, customer-support facilities, WhatsApp Business communications, RCS communications, and other related services made available by AMEY FOUNDATION.AMEY FOUNDATION is a proprietorship operating in the foundation/community-service sector. Through its website and communication channels, AMEY FOUNDATION may provide information concerning its activities, initiatives, programmes, services, community activities, enquiries, support facilities, participation opportunities, and other activities undertaken from time to time.By accessing this website, submitting an enquiry, communicating with AMEY FOUNDATION, registering for any activity, requesting information, or otherwise using our digital services, you acknowledge that you have read, understood and agreed to these Terms & Conditions.If you do not agree with any part of these Terms, please discontinue use of the website and related services.These Terms should be read together with the AMEY FOUNDATION Privacy Policy. The Privacy Policy explains how personal information is collected, used, stored and disclosed.Where AMEY FOUNDATION uses third-party platforms such as WhatsApp Business, Meta services, Google RCS for Business, telecom networks, payment gateways, hosting providers, email services, analytics services or other technology providers, the applicable third-party terms and policies may also apply.

Acceptance of TermsYour use of the website or services constitutes your acceptance of these Terms.Where you submit information through a website form, request a callback, initiate a WhatsApp conversation, respond to an RCS message, register for an activity, or otherwise voluntarily communicate with AMEY FOUNDATION, you acknowledge that such interaction may be governed by these Terms and the Privacy Policy.If you are accessing our services on behalf of an organisation, you represent that you have authority to act for that organisation.AMEY FOUNDATION may update these Terms from time to time. Continued use of our website or services after an update constitutes acceptance of the revised Terms, subject to applicable law.

Payment & Billing TermsAMEY FOUNDATION may, depending on the services or activities offered, provide certain paid services, registrations, subscriptions, contributions or other transactions.Where a payment is required, the applicable amount, payment method and relevant conditions will be communicated before the transaction is completed.Unless expressly stated otherwise: prices may be changed prospectively; applicable taxes or statutory charges may apply; payment must be made through an authorised payment method; users must provide accurate payment information; and third-party payment providers may process payment information under their own terms.If AMEY FOUNDATION facilitates a donation, contribution, programme fee or other payment, users should carefully review the information displayed before completing the transaction.Refund eligibility, where applicable, will depend on the specific service, transaction and applicable law.AMEY FOUNDATION does not retain complete payment-card information where payment processing is performed by a third-party payment gateway, except where lawfully required or technically necessary.

9. Subscription Renewal & TerminationWhere AMEY FOUNDATION offers a recurring service or subscription, the applicable renewal frequency and pricing will be disclosed at the time of subscription.Unless otherwise specified, recurring services may continue until cancelled in accordance with the applicable service terms.AMEY FOUNDATION may terminate or suspend access if: you materially breach these Terms; you provide fraudulent information; your activity creates security or legal risks; your use violates WhatsApp, RCS or other third-party policies; required by law; or the relevant service is discontinued.Users may request termination by contacting AMEY FOUNDATION at ameyfoundation19@gmail.com.Termination does not automatically extinguish rights or obligations that by their nature are intended to survive termination.

10. Use of WhatsApp Official API & RCSAMEY FOUNDATION may use WhatsApp Business services and/or RCS for Business to communicate with users.These services may be used for legitimate purposes such as: responding to enquiries; providing requested information; confirming registrations; sending service-related notifications; providing programme updates; customer or participant support; communicating important administrative information; and other communications for which the user has provided appropriate consent.AMEY FOUNDATION will use these communication channels in accordance with applicable law and the applicable policies of Meta, WhatsApp, Google, telecom operators and other relevant service providers.WhatsApp’s Business Messaging Policy requires businesses to obtain appropriate opt-in before sending subsequent WhatsApp messages and to respect requests to stop communications.RCS for Business similarly requires appropriate authorisation to contact telephone numbers and compliance with applicable opt-in and messaging requirements.AMEY FOUNDATION does not represent that WhatsApp or RCS is available on every device, network or geographical location.

11. Message Delivery & Compliance PolicyAMEY FOUNDATION seeks to send only relevant and reasonably expected communications.Users may be required to provide their mobile number and appropriate consent before receiving WhatsApp or RCS communications.Consent may be collected through: website forms; checkbox-based consent; WhatsApp initiation; RCS interaction; telephone or other lawful methods; or other compliant mechanisms.Users may withdraw consent or request that communications stop.A user may request cessation of messages by contacting AMEY FOUNDATION or using available opt-out functionality.AMEY FOUNDATION will maintain reasonable procedures for honouring opt-out requests.Business-initiated WhatsApp communications may be subject to approved template requirements and applicable messaging windows. WhatsApp’s current policy provides that business-initiated conversations on the WhatsApp Business Platform generally use approved message templates, while certain replies to user messages may be sent within the applicable customer-service window.For RCS, AMEY FOUNDATION will use accurate business identification and comply with applicable messaging and opt-out requirements. Google states that RCS business agents must accurately represent their business identity and promptly honour user opt-out requests.AMEY FOUNDATION will not knowingly use messaging services for spam, deceptive practices, impersonation, unlawful activities or communications prohibited by applicable platform policies.


12. Intellectual Property RightsUnless otherwise stated, the website and its original content, including logos, branding, text, graphics, designs, photographs, videos and other materials, are owned by or licensed to AMEY FOUNDATION.Users may view and use website content for personal and lawful informational purposes.You may not reproduce, republish, modify, distribute, commercially exploit or create derivative works from AMEY FOUNDATION content without prior written permission, except where permitted by applicable law.Third-party names, trademarks and logos remain the property of their respective owners.Nothing in these Terms transfers ownership of AMEY FOUNDATION intellectual property to any user.

Disclaimer of WarrantiesTo the maximum extent permitted by applicable law, the website and related services are provided on an “as available” basis.AMEY FOUNDATION does not guarantee that: the website will always be available; all information will always be error-free; communications will always be delivered; WhatsApp or RCS services will operate continuously; third-party platforms will remain available; website content will always be current; or every service will be available to every user.Third-party communication platforms operate independently and may experience outages, policy changes, delivery restrictions, technical limitations or service interruptions.Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded under Indian law.

15. Limitation of LiabilityTo the maximum extent permitted by law, AMEY FOUNDATION shall not be liable for indirect, incidental, consequential, special or unforeseeable losses arising from use of the website or third-party communication services.This may include losses resulting from: interruption of internet services; telecommunications failures; WhatsApp or RCS outages; unauthorised access caused by circumstances outside reasonable control; third-party platform changes; inaccurate information supplied by a user; delays in communication delivery; or events beyond reasonable control.Nothing in this section limits liability where such limitation is prohibited by applicable Indian law.

16. IndemnificationTo the extent permitted by law, users agree to indemnify and hold harmless AMEY FOUNDATION, its proprietor, representatives, employees, volunteers and service providers against claims, losses, liabilities and reasonable expenses arising from: breach of these Terms; unlawful use of the website; misuse of communication services; infringement of third-party rights; fraudulent information submitted by the user; or violation of applicable laws or platform policies.This obligation will apply to the extent the relevant loss results from the user’s acts or omissions.

17. Governing Law — IndiaThese Terms shall be governed by and interpreted in accordance with the laws of India.Subject to applicable law, disputes arising from or relating to these Terms shall be subject to the jurisdiction of competent courts in Maharashtra, India.Nothing in these Terms prevents either party from seeking urgent or equitable relief where legally available.

Changes to TermsAMEY FOUNDATION may revise these Terms when reasonably necessary, including due to: changes in law; changes in services; changes in technology; changes in WhatsApp or Meta policies; changes in RCS or Google policies; security requirements; or operational requirements.The updated version will be published on the website with an updated effective date.Continued use of the website following material changes may constitute acceptance, to the extent permitted by law.
